Review the instructional videos below, and apply the CASE BRIEF methods presented in the instructional videos, utilizing and applying the case BRIEF methods described, to this case (Bostock v. Clayton County, Georgia). Remember a Case Brief is supposed to be BRIEF (no more than 3 pages for this case). State each of the following:
1) Case Title and Citation
2) Facts: Summarize the major important relevant FACTS. List ONLY the facts you need to understand the holding and reasoning of the case.
Do NOT simply cut and paste long portions of the case.
3) Procedural Posture/History/Background/Previous Rulings in Lower Court Decisions
4) Issue: State is Legal ISSUE the Court had to decide. What question is it that the Court needs to answer. This must be written in the form of a question.
3) Holding/Ruling: State how the Court answered, or decided on, the issue in question.
4) Rule(s): State the established rule(s) of law or legal principle(s) the Court considered and applied to decide the issue.
5) Reasoning/Analysis/Application: Discuss the REASONING in its ANALASYS of the law in relation to the facts, that explains how the Court applies the rule(s) to the facts to reach the decision that it did? Be specific. This should be the longest portion of the case brief where you can demonstrate your understanding of the case.
6) Dissenting Opinion: State the Court’s dissenting opinion(s) here. Give the reasoning behind the dissenting opinion(s). All the Supreme Court Justices are the top legal minds in the world and all have compelling positions and perspectives. You may believe the dissenting judge(s) argument(s) are more compelling than the majority. Point out why you believe the dissenting opinion(s) to be compelling, or unpersuasive.
7) Conclusion: State the CONCLUSION and ruling/order/decree of the Court. In other words, who won the case and what was awarded, meaning what was the losing party(ies) ordered to do, or refrain from doing.
8) Comments: State the rule this case established or developed, or precedent established to be used as authority in future cases or similar circumstances. Give your ideas of the significance or impact this case will have on society.
Organize your responses so that your submission is suitably presentable for review and assessment by performing the above steps [1-8].
Do NOT simply cut and paste long portions of the case, or you will receive point deductions on the assignment. All typing should be your own.
