The Scenario
You are the ER manager of a company that runs a large citrus growing cooperative in regional Victoria. The cooperative is owned by your boss. The industry was financially devastated when international borders closed in 2020 and temporary migrant workers were not permitted to enter the country to pick fruit. See: Fruit-picking baskets empty as labour shortage begins to bite.
But with Australia’s borders open again and vaccination rates high, your boss is seeking to source workers to work on the farms. In particular, she is considering employing workers on the Working Holiday Visa (subclass 417 and 462) to pick fruit. However, she has some concerns. She has been reading about exploitation and wage theft that is rife in some sectors of the economy (e.g. hospitality, retail, agriculture); and particularly for some groups of workers including those on the working holiday visa. She knows you have industry experience and a postgraduate degree in Human Resource Management, so she has asked for your help.
Assessment task:
Report to Management
Your boss has asked you to provide her with a report. Specifically, she would like a report that:
- Proposes, with evidence to support your claims, three possible benefits to the company and/or to other stakeholders of employing temporary migrant workers on the Working Holiday Visas to pick fruit: and
- Analyses two risks to the company of employing temporary migrant workers on the Working Holiday Visas to pick fruit; including how or whether these risks can be managed.
You understand that whatever you recommend, it must comply with migration laws on employing temporary working holidaymakers in horticulture, and with employment laws in the Fair Work Act 2009 and any other relevant legislation.
