Assignment task
Constantine, an aged passionate philanthropist and environmental advocate, intends to leave a last will which contains several gifts intended for charitable purposes. However, Constantine doubts whether the language and conditions in his will may raise concerns about their validity after his death.
Examine the following provisions in Constantine’s will:
(a) £200,000 to my trustees for the creation and upkeep of a meditation grove in the grounds of St Mary’s Church, for the spiritual enrichment of the local community.
(b) £25,000 to my trustees to be allocated to such organizations to promote sustainable agriculture and green technologies as they shall at their absolute discretion choose.
(c) £75,000 To my trustees for the advancement of music education in the private schools of Kent.
Consider whether these gifts are charitable. Evaluate any potential challenges to the validity of any of the above and propose amendments to enhance their validity and effectiveness.
